General Terms and Conditions (GTC) of the Luftzeiten platform and the participating pilots

Legal explanation

Paragliding tandem flights are carried out exclusively by licensed, certified and experienced paragliding tandem pilots who act as independent sole traders, hereinafter referred to as pilot(s).

We are a team of independent pilots, which are listed below:

  • Johannes Chalk, Ennerbachstr. 16, D-79674 Todtnau
  • Lorenz Dycke, Blauenstr. 55, CH-4054 Basel
  • Karl-Micheal Hüglin, Haupstr. 62, D-79367 Weisweil
  • Thomas von Renner, Alice-Salomon. Str. 8, D-79111 Freiburg
  • Ralf Bosch, Ludwig-Zier-Str.24, 78120 Furtwangen
  • Dirk Rüsen, Baslerstr. 10/1, 79400 Wollbach

The contractual partner for a paragliding tandem flight is the pilot himself. When purchasing a voucher, this is the pilot who issued the voucher. When the passenger takes off, a contract of carriage is concluded between the respective pilot and the passenger. When carrying out a paragliding tandem flight, the pilot carrying out the flight is therefore the entrepreneur of the service and thus the liable contractual partner vis-à-vis the passenger.
The pilot carrying out the flight is responsible for flight planning and the safe execution of the paragliding tandem flight. The obligations of the passenger in accordance with the conditions of carriage, see contract of carriage, remain unaffected.

Conditions of carriage in accordance with the contract of carriage
  • 1. the safe execution of the passenger flight with the paraglider requires the passenger to follow the pilot's instructions for the take-off preparations, the take-off itself, the flight and the landing exactly. These instructions will be given to the passenger as part of the pre-flight briefing. There is an increased risk of accidents, particularly during take-off and landing. During these phases, the pilot must be particularly confident that the passenger will carry out the necessary procedures and movements as explained in the pre-flight briefing or as directly instructed by the pilot. The passenger must be aware that incorrect behaviour can lead to accidents with the risk of serious physical injury. This includes, for example, ending the take-off run before take-off, assuming a seated position before the pilot instructs this, behaviour in flight that grossly distracts the pilot from performing his duties as pilot of the aircraft, not assuming the running or sitting position during landing that the pilot instructs for a safe landing or not running or not running sufficiently during the run landing.
  • 2. the pilot is obliged to cancel the agreed passenger flight if the weather conditions are not safe enough to carry out the flight properly, if he has reasonable doubt that the passenger can safely meet the requirements of the flight or will follow the instructions, or if he determines that a technical defect in the equipment prevents the flight from being carried out safely.
  • 3. the passenger is obliged not to take the agreed passenger flight if he/she is under the influence of alcohol/drugs, under the influence of narcotic, mind-altering or stimulant medication, suffers from a circulatory, nervous, cognitive, cardiac or musculoskeletal disorder or has not received the instructions given by the pilot under 1. or has not understood them.
  • 4. the existing passenger liability insurance of the air carrier or the equipment owner covers liability for damages within the scope of the statutory provisions (Sections 44 et seq. of the German Air Traffic Act). This applies to damage to health, bodily injury and even death of a passenger due to an accident. To the extent permitted by law, the passenger releases the carrier(s) and their employees as well as the owner from any liability that goes beyond existing insurance policies.
  • 5. all items carried, e.g. camera, mobile phone, glasses, are the sole responsibility of the passenger.
    Scheduling

Flight appointments can be arranged with any of the pilots listed above.
The provisional reservation or pre-booking of a flight date does not constitute the conclusion of a contract.
This only comes into effect when the flight takes place on site between the pilot carrying out the flight and the passenger. We would like to point out that despite firmly agreed flight dates, there is no entitlement to a tandem flight if, for example, the prevailing weather conditions, illness or the suitability of the passenger do not permit this. This assessment is at the sole discretion of the pilot carrying out the flight.
In the event of cancellation or postponement of the flight at short notice, there is therefore no entitlement to reimbursement of other costs incurred (e.g. travel, accommodation, etc.).

An agreed flight date is a binding reservation. Should the passenger wish to cancel or postpone their flight date, please let us know in good time.
In individual cases, the pilot or agent may also request a deposit for a reservation. In the event of unsuitable flying weather, the flight date can be postponed or cancelled free of charge.

    Vouchers

A voucher is generally valid for 3 years from the date of issue and can be redeemed within this period. In order to redeem a voucher, it is necessary to arrange a flight date in advance. If the tandem flight cannot take place at the agreed flying site, e.g. due to weather conditions, the pilot may offer to carry out the flight at one of our other flying sites. However, the pilot is not obliged to do so, in which case the flight date must be postponed.

    Payment advice

Payment for a tandem flight is made either in advance after the payment details of the respective pilot's contractual partner have been provided or in cash at the start of the flight. Vouchers will only be dispatched after receipt of payment by the respective pilot.

Rights of use of image material

The passenger agrees that all photo and video recordings made during a tandem flight with the pilot may only be used for private purposes. The sale and commercial use of photographic material requires the prior consent of the respective pilots. The pilot in turn confirms that the image material may only be used for advertising purposes, e.g. homepage, with the express consent of the passenger.

    Cancellation policy

Contractual declarations can be cancelled in writing within 14 days without giving reasons, provided that the actual service has not yet been provided.
